Terms of Service
These Terms are a working business draft for review by counsel before production launch. Daily Tools is operated by GoEnhanced LLC.
1. Purpose of Daily Tools
Daily Tools is software designed to support everyday organization and greater independence, especially for neurodivergent individuals and others who benefit from additional structure, together with families, caregivers, coaches and trusted supporters. Features may include routines, goals, plans, rewards, schedules, money/value learning, communication, life planning and optional wellness tracking.
2. Not professional or emergency care
Daily Tools is not a medical device or healthcare provider and is not intended to diagnose, treat, cure, mitigate or prevent disease or replace medical, mental-health, legal, financial, tax, employment, emergency or other licensed professional advice or care. Do not rely on Daily Tools for emergencies or time-critical medication or safety decisions.
3. Accounts and eligibility
Users must provide accurate information, protect account credentials and use the service lawfully. Account owners are responsible for activity performed through their accounts except to the extent otherwise required by law. Age, parental-consent and supported-user requirements will be applied as required by applicable law and the final production policy.
4. Supporters and permissions
Family members, caregivers, coaches, professionals and other supporters may access another person's information only through an authorized relationship and the permissions made available by Daily Tools. Paying for a Professional or other plan does not automatically grant access to a client's or another user's private information. Users should invite only people they trust and may revoke access as supported by the product.
5. User-entered content
Users remain responsible for information, notes, messages, schedules, goals and other content they enter. General-purpose free-text fields can contain information Daily Tools did not request. Users should avoid entering medical or other highly sensitive information in general-purpose fields unless the relevant feature is intended for that information. Users may not enter another person's information without an appropriate right or authorization.
6. Optional sensitive/wellness features
Some optional features may process menstrual-cycle, mood, sleep, medication-related, weight/height or similar wellness information. Availability of such features may vary by account, jurisdiction or product configuration. Additional notices, choices or consent may apply. GoEnhanced LLC may disable or restrict a feature where needed for legal, security or operational reasons.
7. Subscriptions, renewal and cancellation
Paid subscriptions are billed according to the price and billing interval shown at checkout. Recurring subscriptions renew automatically until canceled, subject to the cancellation process and any notice or renewal rights required by applicable law. Prices and plan contents may change for future purchases or renewals after any notice required by law.
8. Refunds
Refund rights are governed by the offer presented at checkout and applicable law. Except for an expressly stated refund period or a remedy required by law, fees are generally non-refundable after the applicable refund period. Nothing in these Terms waives rights that cannot legally be waived.
9. Founding Lifetime Access
If expressly offered to a selected customer, “Lifetime” or “Founding Lifetime Access” means the commercial life of the applicable Daily Tools service while GoEnhanced LLC continues to operate and generally make that service available; it does not mean the purchaser's biological lifetime and is not a promise that the service will operate indefinitely.
Unless expressly included in the specific offer, future standalone products, premium modules, AI services, SMS/messaging, additional storage, paid integrations, professional services and other incremental third-party or usage-based services may be priced separately. Lifetime Access is non-transferable unless agreed otherwise in writing and remains subject to these Terms and acceptable-use requirements.
10. Payments and third-party services
Payment processing is provided by Stripe. Daily Tools may also depend on Google/Firebase and other hosting, authentication, communications, analytics or infrastructure providers. Use of third-party features may be subject to those providers' terms and availability.
11. Acceptable use
Users may not attempt unauthorized access, interfere with or reverse-engineer protected portions of the service except where law permits, use Daily Tools to violate another person's rights, upload unlawful or malicious content, evade security or usage controls, or use the service unlawfully.
12. Service changes and availability
Daily Tools may add, change, replace, restrict or remove features as the service evolves. GoEnhanced LLC does not guarantee uninterrupted or error-free availability. It may suspend or discontinue all or part of the service when continued operation is no longer commercially, technically, legally or operationally reasonable. If the service is permanently discontinued, GoEnhanced LLC intends to provide commercially reasonable notice and, where reasonably available, an opportunity to export user data, subject to applicable law.
13. Intellectual property
Daily Tools, its software, branding, design and original content are owned by or licensed to GoEnhanced LLC and are protected by applicable intellectual-property laws. These Terms grant users a limited, revocable, non-transferable right to use the service for its intended purpose while their access remains valid.
14. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law, Daily Tools is provided on an “as is” and “as available” basis without warranties not expressly stated in writing. Any limitation of liability, exclusion of consequential damages, warranty disclaimer or cap on liability in the final Terms must be reviewed by counsel and will apply only to the extent permitted by law.
15. International users and governing law
Daily Tools is operated from Texas, United States. Subject to rights that cannot legally be waived, these Terms are intended to be governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law principles. Users outside the United States are responsible for complying with laws applicable to their use, and nothing here limits mandatory consumer or privacy rights that cannot lawfully be waived.
16. Termination
Users may stop using Daily Tools and may cancel paid subscriptions through the available cancellation process. GoEnhanced LLC may suspend or terminate access for material violations of these Terms, security threats, unlawful use or nonpayment, subject to applicable law.
17. Changes to these Terms
These Terms may be updated as the service, business or legal requirements evolve. Material changes will be communicated as required by applicable law.
